Terms & Conditions (AGB)

Allgemeine Geschäftsbedingungen — Last updated: October 2026

§1 Scope

These Terms & Conditions apply to all orders placed via shodai.de by consumers and businesses. The contract language is German or English, depending on the language of the website you order in.

§2 Contract Formation

Your order constitutes a binding offer. The contract is formed once we send you an order confirmation by email or deliver the goods.

§3 Prices & Payment

All prices are in euros and include applicable German VAT (MwSt). Payment is accepted by credit or debit card, from your Shodai wallet balance, or by Cash on Delivery (within 5 km of our Cottbus or Berlin shop). Shipping costs are shown before you place your order.

§4 Delivery

Local delivery within 5 km of our Cottbus or Berlin shop: ordered 9:00–13:00 → delivered 14:00–16:00 · ordered 13:00–18:00 → delivered 19:00–21:00 · ordered after 18:00 → delivered the next delivery day. We do not deliver on Sundays: orders placed on Saturday after 18:00 or on a Sunday are delivered on Monday, 14:00–16:00. All other addresses are shipped with DPD, with no same-day delivery; the delivery time depends on DPD. Delivery dates are targets, not fixed deadlines, unless we have expressly confirmed a date.

§5 Availability and Refunds

If an ordered item turns out to be unavailable, we will tell you and remove it from the order. Amounts that have to be refunded because of a cancelled order or an unavailable item are credited to your Shodai wallet, can be used for any later order, and on request are paid back to the payment method you used.

§6 Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days. Details, the exclusions (for example fresh and frozen food) and the model withdrawal form are on the Right of Withdrawal page.

§7 Warranty

The statutory warranty rights apply. Please report damaged or incorrect goods to us without delay at info@shodai.de.

§8 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. In case of slight negligence we are liable only for the breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on which you can regularly rely), and then limited to the foreseeable damage typical for this type of contract. Otherwise liability is excluded.

§9 Governing Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this applies only to the extent that it does not remove mandatory consumer protection of the country they live in. For businesses the place of jurisdiction is Cottbus, Germany.

§10 Dispute Resolution

We are not willing or obliged to take part in dispute resolution proceedings before a consumer arbitration board.
